General Laws c. 260, § 2B, which places a time limit on the tort liability of architects, engineers, and building contractors, is not applicable to contract actions for breach of an express warranty. [822-823] A cause of action against the designer of a foundation and mooring system for a boat, for breach of an express warranty that the mooring system would be sufficient and adequate to keep the boat permanently moored under expected wind and tidal conditions did not accrue until the plaintiff discovered the breach when the boat capsized during a storm.
